Terms of Service for Fabric Quality Scan

1. Description of Service

Fabric Quality Scan is a mobile application that allows users to scan fabrics and receive AI-powered analysis of fabric composition, type, and characteristics. Images are processed ephemerally — they are analyzed in real time and immediately discarded. No user accounts are required.

IMPORTANT: Fabric Quality Scan provides informational analysis only. Results are generated by AI and may not be fully accurate. Do not rely solely on Fabric Quality Scan for critical decisions regarding fabric composition, safety, or care. Always verify important fabric information through professional testing or manufacturer labels.

2. User Content and Image Handling

• License to Use Images: To provide the analysis, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, process, and display the images you submit solely for the purpose of operating and improving the Service, including performing the fabric analysis.
• Ephemeral Processing: Images you submit are processed in real time by our AI service. Images are not stored on our servers after analysis is complete. No history of your scans is maintained on our end.
• Responsibility for Content: You are solely responsible for the images you submit. You agree not to submit images that are illegal, obscene, defamatory, or otherwise objectionable.

3. In-App Purchases and Subscriptions

The Service may offer features through in-app purchases, subscriptions, or credits ("Paid Services"). These may be managed through third-party payment processors (e.g., Apple App Store, Google Play Store).

• Free Scans: We may offer a certain number of free fabric scans.
• Payment: By purchasing Paid Services, you agree to pay the applicable fees. All payments are non-refundable except as required by law or as explicitly stated in our refund policy.
• Subscription Terms: Subscriptions may renew automatically unless canceled. You are responsible for managing your subscriptions.

4. Analytics and Data Collection

We use third-party analytics services to understand how users interact with our Service and to improve user experience:

• Mixpanel: We use Mixpanel to collect anonymized usage analytics, including app interactions, feature usage patterns, and performance metrics. This helps us understand user behavior and improve our service.

5. Consent

By using the Service, you consent to the collection, use, processing, and storage of your information as described in these Terms and our Privacy Policy. The application may present you with consent dialogs for specific features or data processing activities, including analytics tracking.

6. Prohibited Conduct

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE. THE ANALYSIS PROVIDED IS FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS A DEFINITIVE DETERMINATION OF FABRIC COMPOSITION OR CHARACTERISTICS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL APPNORD AS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
