Terms of Service for Dog Pain Scan

1. Description of Service

Dog Pain Scan is a mobile application designed to assist users in assessing potential pain in dogs through image analysis. Users can upload images of their dogs, which are then processed and analyzed to provide an assessment. The Service may also include features such as assessment history and user accounts.

IMPORTANT: Dog Pain Scan is not a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the advice of your veterinarian or other qualified health provider with any questions you may have regarding a medical condition or the health of your pet. Never disregard professional veterinary advice or delay in seeking it because of something you have read or interpreted from the Service.

2. User Accounts

To use certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Content and Image Handling

• License to Use Images: To provide the assessment, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, process, and display the images you upload solely for the purpose of operating and improving the Service, including performing the pain assessment.
• Image Processing: When you upload an image, it will be processed (e.g., cropped or resized) on your device. The processed image is then transmitted to our backend service provider (Supabase) for analysis by an automated system.
• Data Storage:
  • The processed image and the corresponding assessment result will be stored locally on your device.
  • You can delete your assessments from the application. Deleting an assessment will also delete the associated processed image stored locally on your device.
• Responsibility for Content: You are solely responsible for the images you upload and ensure that you have the necessary rights to upload them and grant us the license described above. You agree not to upload images that are illegal, obscene, defamatory, or otherwise objectionable.

4. In-App Purchases and Subscriptions

The Service may offer features through in-app purchases, subscriptions, or credits ("Paid Services"). These may be managed through third-party payment processors (e.g., RevenueCat, Apple App Store, Google Play Store).

• Free Assessments: We may offer a certain number of free assessments.
• Payment: By purchasing Paid Services, you agree to pay the applicable fees. All payments are non-refundable except as required by law or as explicitly stated in our refund policy.
• Subscription Terms: Subscriptions may renew automatically unless canceled. You are responsible for managing your subscriptions.

5. Analytics and Data Collection

We use third-party analytics services to understand how users interact with our Service and to improve user experience:

• Mixpanel: We use Mixpanel to collect anonymized usage analytics, including app interactions, feature usage patterns, and performance metrics. This helps us understand user behavior and improve our service.

6. Consent

By using the Service, you consent to the collection, use, processing, and storage of your information as described in these Terms and our Privacy Policy. The application may present you with consent dialogs for specific features or data processing activities, including analytics tracking.

7. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to harass, abuse, or harm another person.

8. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of Appnord AS and its licensors. The Service is protected by copyright, trademark, and other laws.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE. THE ASSESSMENTS PROVIDED ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL VETERINARY JUDGMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Appnord AS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
